Anticipatory breach of contract is a legal concept found in British and American law systems. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and Chinese Contract Law have incorporated this concept. By comparing and contrasting the treatment of anticipatory breach in CISG and Chinese Contract Law, the paper suggests ways to enhance the handling of anticipatory breach in Chinese Contract Law.
