The article discusses how public law and the "rule of law" tradition differ in Germany and Britain. In Germany, public law is based on legislative reason, while in Britain, it is based on judicial reason. This means that the role and function of public law vary between the two countries. In China, the study of public law cannot ignore Kantian Rechtssaat or Hegelian "ethical nation".
