China's Administrative Law System Leads to Autocracy and Misuse of Power
The current legal system in China gives the State Council and related authorities the power to interpret administrative laws, rules, and regulations. This excludes other institutions and administrators from interpreting administrative laws, and judicial organs from interpreting rules and regulations. This system leads to administrative autocracy, misuse of power, and a lack of control over administration by the law. To address these issues, it is important to establish a judicial system to review administrative rules and regulations, and improve the interpretation system of administrative law.
