The rural collective ownership of land in China has evolved over time, with the system being seen as a unique form of ownership. It is not simply a copy of Western models but rather a tailored economic and legal institution that suits China's rural production capabilities. By drawing on traditional collective ownership theories from Germanic law, a new theory system for rural land ownership in China can be constructed.
