Dignity-centered gender equality tests may undermine women's rights in Canada and South Africa.
The article examines how the concept of dignity is used in Canadian and South African courts to determine gender equality. Both countries have focused on dignity to promote equality, but this approach has not always been successful. By equating discrimination with violations of dignity, courts may have actually hindered women's rights instead of helping them. It is suggested that courts in both countries should move away from relying too heavily on dignity when deciding cases of gender equality.
