Supreme Court's decisions may not be followed by lower courts.
The Supreme Court doesn't always have lower courts follow its decisions. This can be because the Supreme Court itself may want to change its own policies. If the Court's members or their views change, they might prefer a new policy set by a lower court over their old one. So, if an appeals court doesn't follow a previous Supreme Court decision, it might not be breaking the rules. The Supreme Court might actually prefer the new decision. Understanding when the Supreme Court will stick to or change its decisions is important for knowing how lower courts will act. This study created a model to help explain this issue.
