Liability insurance leads to better care than liability law alone.
Liability insurance can affect how careful people are in maritime situations. When someone has insurance, they might not be as careful because they don't have to pay for mistakes themselves. This is called "moral hazard." Some studies have looked at how to deal with this problem, but not many have compared liability laws and insurance to see which one encourages better care. This paper argues that having liability insurance actually makes people more careful than just having liability laws.
