Bailee's Liability Transformed: Domestic Law Triumphs over Common Law in Protecting Consumers
The article compares civil liability laws in common law and Iran, focusing on bailee's liability. It discusses different bases for liability, such as negligence, strict liability, and objective liability. While strict liability may not stand alone, negligence is rooted in the behavior of the damage creator, and objective liability can be an independent basis for liability. Both legal systems show evidence of a connection in their liability foundations. In terms of suppressing bailee's breaches, domestic law, especially in Iran, has accepted absolute liability and is more successful than common law.
