EU Court of Justice's Power Criticized, Calls for Stronger Legislative Authority
The EU Court of Justice has more power than the EU legislature in making laws. This article argues that the Court's authority is based on the outcomes it produces, but this is not enough to legitimize EU institutions. The EU should be judged by demoicratic standards of legitimacy, which support legislative decision-making. The article questions if the EU legislature can be given more political power without changing the Treaty.
