New Hungarian Fundamental Law Fails to Meet Democratic Criteria: Study
Comparative law is important for making and understanding constitutions, including Hungary's. The new Hungarian Fundamental Law of 2011 caused controversy internationally. Different opinions on it stem from differing views on democracy. Some support it for national sovereignty, while others criticize it for not aligning with global constitutional values. By using Joseph Raz's criteria, it was found that the new law doesn't meet the standards for acceptance by the whole society, as it was quickly approved without input from opposing parties or a referendum.
