The article discusses challenges facing the Rule of Law in China and proposes a new theory based on the philosophies of Whitehead and James. It addresses issues of legal uncertainty and the gap between legal theory and practice. The proposed theory aims to bridge cultural differences between East and West by emphasizing unity-in-diversity. This new approach suggests that the ideal Rule of Law may vary between countries and should reflect cultural differences in interpreting democracy and individual rights.
