The article discusses the need for a European constitution to prevent misuse of power by representatives in the European Union. It suggests that introducing elements of direct democracy can help create a European demos and increase control over the EU legislature and executive. Direct democracy is proposed to address the European democratic deficit. A transparent assignment of competencies and rules is needed to resolve conflicts in a European federation, which should follow the principles of competitive federalism.
