Global Corporations Face Legal Accountability in Alien Tort Claims Act Cases
The Alien Tort Claims Act allows foreign individuals to sue multinational corporations in US courts for certain torts committed anywhere in the world. Jurisdiction can be established through minimal territorial presence or transitory jurisdiction. For example, a plaintiff sued Royal Dutch Shell in New York because the company had a small office there. Another case involved serving a Serbian-Bosnian war criminal at Kennedy Airport. The Act has been used successfully in cases involving human rights abuses, even though prior to recent years, there were very few ATS opinions.
