Injunctions in Public Law Cases: Strengthening Constitutional Rights Protection
In public law cases, having an injunction to protect your rights is more effective than just the threat of damages. This study challenges the idea that injunctions are unnecessary by showing that they provide the highest level of protection for constitutional rights. When a court issues an injunction, it significantly helps in safeguarding public law entitlements, especially when there are high costs or when violations affect politically weak groups. The current rules should be changed to make injunctions more accessible and consistent in public law cases.
