Government Guarantees in Public-Private Partnerships Lead to Higher Contract Disputes
Public-private partnerships (PPPs) in emerging and developing countries face challenges due to high contractual disputes despite government support. A study analyzed 6,000 PPP contracts and found that governments offering guarantees have higher disputes, linked to financial needs, budget transparency, and bureaucratic efficiency. Better PPP management and budget transparency lead to longer PPP survival. In summary, fiscal institutions influence PPP contract selection and dispute probability, with guarantees increasing disputes due to adverse selection and contingent liability effects.
