The relationship between private law and the rule of law has been overlooked until recently. The chapter explores why this gap exists and suggests reasons related to the U.S. legal academy and private law theory in the commonwealth. It outlines ways to bring a rule-of-law perspective to private law theory and highlights the importance of understanding how private power operates in the global data economy.
