International Contract Breaches Now Have Clear Consequences Under New Definition
The fundamental breach of contract in international sales is when one party seriously harms the other's rights under the agreement. This allows the harmed party to cancel the contract. For this breach to happen, two things must occur: the breaching party must break a contract rule and cause significant harm, and they should have seen this harm coming. Even if they didn't predict the harm, if a reasonable person in their shoes could have, it still counts as a serious breach.
