New Civil Code Defines Liability for Breaching Rights and Interests
The Romanian new Civil Code outlines the rules for civil liability, inspired by Quebec's Civil Code. It states that everyone must follow the law and not harm others. If someone fails to fulfill a contract, they are responsible for any resulting damage. There are two types of liability: for one's own actions and for someone else's actions. An illicit act is when someone breaks the law and causes harm. The damage is the negative outcome of the illicit act. The causal relationship links the illicit act to the damage. The new regulation maintains the same view on causality as before. If someone causes harm through an illicit act, they are liable. The act must violate a legal rule and harm someone's rights or interests. Intention and fault are the two forms of civil guilt, clearly defined in the new regulation.
